THIS PARTICULAR YEAR IS A DIFFERENT YEAR FROM TYPICAL FOR LIGHTING AND LANDSCAPE MAINTENANCE.

ZONE 4-2 IS GETTING OR IS PROPOSED.

ZONE FIVE IS GETTING A PROPOSED DECREASE.

THE REASON FOR THAT DECREASE IS ZONE FIVE HAS A HEALTHY RESERVE AND ONE THAT WE'RE TRYING TO SPEND DOWN TO MAKE SURE THAT WE'RE NOT OVER BUILDING THE RESERVES AND DOING I GUESS, MAINTAIN OUR FIDUCIARY DUTY TO THOSE PROPERTY OWNERS IN THAT ZONE.

ZONE SIX IS THE ONLY EXISTING ZONE ACTUALLY, OUT OF ALL THE DISTRICTS THAT ALREADY HAS A CPI INFLATOR AND THAT CPI INFLATOR IS CAPPED

WE'VE HAD SOME OF THESE SERVICES FOR MANY YEARS, BUT SOME OF THEM PROVED TO BE VERY BENEFICIAL AND NOT ONLY THAT, THEY'RE VERY PRUDENT AND THEY'RE VERY COST EFFECTIVE.

SO BUT WE WANT TO MAKE SURE THAT WE'RE TRANSPARENT ON WHAT WE'RE DOING TO SHOW WHAT THE COSTS ARE, WHAT THE NEW COSTS ARE, AND COMPARE SERVICES AND SOME OF OUR SERVICES WE HAVE, ESPECIALLY WITH WATER THERE'S SOME SPECIALIZED SERVICES, PUMPING COMPANIES SPECIAL PROGRAMABLE CONTROLS AND THINGS LIKE THAT WE WERE KIND OF OBLIGATED TO A CERTAIN EXTENT, BUT WE STILL WANT TO SEE THE COMPETITIVE ASPECT OF IT.

BEFORE I GET INTO MY REPORT, I DID WANT TO BRING TO YOUR ATTENTION THAT ON THE DAIS BEFORE YOU THIS EVENING, OUR ADDITIONAL CORRESPONDENCE THAT THE CITY RECEIVED AFTER THE AGENDA PACKET WAS PREPARED AND PRESENTED TO THE PUBLIC LAST WEEK.

ALL OF THESE DOCUMENTS WILL BE MADE PART OF THE OFFICIAL RECORD WITH THE MINUTES OF TONIGHT'S MEETING.

BUT THEY ARE ON THE DAIS FOR YOUR REVIEW.

AS THE MAYOR MENTIONED, THIS TONIGHT'S ITEM IS TO DISCUSS THE POTENTIAL RENEWAL OF THE OUTDOOR PATIO PERMIT FOR CAFE WING AT 2316 D STREET.

SO STARTING BACK IN 2020 IN ON ACTUALLY, ON JULY 1ST OF 2020, THE CITY CLOSED THE SECTION OF D STREET BETWEEN MEDINA AND THIRD IN ORDER TO ALLOW THE BUSINESSES, THE RESTAURANTS ON THAT STREET TO EXPAND AND TO BUILD OUT OUTDOOR PATIOS.

AS THE MANDATES FOR THE COVID PANDEMIC STARTED ALLOWING FOR OUTDOOR DINING AT THAT POINT AND FOR BASICALLY THAT ONE YEAR UNTIL THE SUMMER OF 2021, THE STREET REMAINED CLOSED.

THERE WAS SOME BACK AND FORTH WITH THE MANDATES, AS YOU'LL RECALL, WHERE THE STREET WAS REOPENED AND THEN SHUT BACK DOWN AGAIN, BUT BASICALLY IT WAS CLOSED FOR A FULL YEAR.

ALMOST ALL THE RESTAURANTS ON THIS SECTION OF D STREET WERE TAKING ADVANTAGE OF THE OUTDOOR SPACE ALONG THE STREET IN THE PARKING SPACES.

CLOSE BEING CLOSE, THE VEHICLES, I SHOULD SAY, AND NOT TO PEDESTRIANS, OBVIOUSLY.

ONCE THE INDOOR LIMITATIONS BEGAN TO BE LIFTED THE SUMMER OF 2021, THE OLD TOWN LA VERNE BUSINESS IMPROVEMENT DISTRICTS ADVISORY BOARD, I'LL PROBABLY JUST REFER TO THEM AS THE BOARD GOING FORWARD FOR CLARIFICATION, BUT THEY MADE A RECOMMENDATION TO THE CITY COUNCIL TO REOPEN THE STREETS AT

THAT TIME. BECAUSE THE OUTDOOR PATIO SPACES WERE NOT BEING USED AS OFTEN AND THE INDOOR RESTRICTIONS HAD BEEN REDUCED.

AT YOUR JULY 19TH, 2021 MEETING, YOU DID VOTE TO REOPEN THE STREET, BUT DID ALLOW FOR EXPANDED OUTDOOR PATIO SPACES, BASICALLY IN THE PARKING SPACES FOR ANY BUSINESSES IN OLD TOWN THAT WERE INTERESTED IN DOING SO AND AT THAT TIME, IN THAT DIRECTION WAS FOR THE FORESEEABLE FUTURE AND THAT'S THE IMPORTANT PART WHY WE'RE HERE TONIGHT.

IMMEDIATELY THE OWNERS OF CAFE WANG, WHO ARE HERE TONIGHT EXPRESS INTEREST IN TAKING ADVANTAGE OF THE ABILITY TO HAVE EXPANDED OUTDOOR DINING BESIDES THE SIDEWALK AREAS THAT RESTAURANTS HAVE BEEN USING AND CONTINUE TO USE TO THIS DAY.

THEIR INITIAL SETUP.

THEY'RE WORKING WITH AN ENCROACHMENT PERMIT THROUGH PUBLIC WORKS.

DID NOT WAS NOT THE PATIO THAT YOU SEE ON D STREET TODAY? IT WAS NOT BUILT UP OR RAISED.

IT WAS A SERIES OF WATER BARRICADES, EASY UPS TEMPORARY TABLES AND CHAIRS.

THAT WAS PUT UP PRETTY IMMEDIATE.

THIS DESIGN OR LACK OF DESIGN, IF YOU WILL, DID RESULT IN COMPLAINTS RECEIVED BOTH BY US HERE AT CITY HALL AS WELL AS THE BOARD AND THE BUSINESSES IN THE OLD TOWN AREA.

THE BOARD DID ASK ABOUT WHEN THAT PERMIT WOULD EXPIRE AND THE ENCROACHMENT DIDN'T HAVE A BUILT IN EXPIRATION DATE.

AGAIN, THE COUNCIL'S DIRECTION WAS TO ALLOW THIS FOR THE FORESEEABLE FUTURE AT THAT TIME.

BUT THEIR INSURANCE POLICY THAT THE CITY REQUIRES AS PART OF THAT PERMIT DID HAVE AN EXPIRATION THAT WOULD BE RENEWABLE.

BUT IF NOT RENEWED, THEN THE PERMIT WOULD BE INVALID.

SO THE BOARD GAVE DIRECTION IN DECEMBER OF 21 TO NOT ALLOW FOR A RESUBMITTAL OF THE INSURANCE, EFFECTIVELY DENYING THE PERMIT THAT WAS ISSUED TO REQUIRE THAT THE OUTDOOR TEMPORARY PATIO BE REMOVED.

THE BUSINESS OWNERS WERE INTERESTED IN KEEPING THE OUTDOOR PATIO, SO THEY MADE A PROPOSAL BACK TO THE BOARD AT THE SUBSEQUENT MEETING IN JULY OF 2022.

I'M SORRY, JANUARY OF 2022 TO BUILD OUT WHAT YOU SEE TODAY.

BASICALLY A MORE IMPROVED ESTHETICALLY MORE DESIGNED PATIO, IF YOU WILL.

IT'S SIMILAR TO THE PATIOS THAT THE CITY OF CLERMONT MANDATED FOR THEIR RESTAURANTS.

IF THEY WERE TO EXPAND, THE PLANS WERE TAKEN BY THEM, BUT IT WAS BUILT AT A CONSIDERABLE COST TO THE RESTAURANT AND AS SUCH, DURING WITH THAT PROPOSAL, THE RESTAURANT OWNERS ASKED THE BOARD TO PROVIDE THEM WITH A CERTAIN AMOUNT OF TIME AND CERTAINTY THAT THE PATIO WOULD BE ALLOWED TO REMAIN AND THAT THEY WOULD SUPPORT.

DURING THAT DISCUSSION, THE BOARD DID IDENTIFY A TWO YEAR PERIOD THAT THEY WOULD BASICALLY AT LEAST ALLOW THE PATIO OR SUPPORT THE PATIO BEING IN PLACE.

YES. SO THESE AGREEMENTS WERE ARE HAVE BEEN PRIMARILY WITH THE DOWNTOWN BOARD.

THE BOARD IS DID NOT MAKE ANY FINAL DECISIONS BASED ON THE COUNCIL'S DECISION TO REOPEN THE STREET TO VEHICLES IN THE SUMMER OF 21.

THEN THE PERMITTING HAS BEEN WITH THE PUBLIC WORKS DEPARTMENT.

BASICALLY, THE BOARD IS JUST A RECOMMENDING BODY TO THE CITY COUNCIL.

THEY DON'T HAVE THE AUTHORITY TO SHUT DOWN STREETS OR TO ISSUE PERMITS.

THAT'S ALL DONE HERE BY STAFF AND PER COUNCIL DIRECTION.

BUT YOU SAID IT WAS THE BOARD THAT SAID THROUGH THEIR INSURANCE POLICY, THEY WOULD NOT THEY WOULD ALLOW IT.

SO THEY WERE THAT'S NOT WHAT THE CITY THAT'S BEEN WHAT THE BOARD WAS RECOMMENDING BASICALLY THAT THE CITY NOT RENEW THE PERMIT, BUT THAT'S NEVER COME TO THE CITY.

IT DIDN'T AND THAT'S BECAUSE OF THEIR SUBSEQUENT MEETING IN JANUARY OF 22.

THEY REVERSED COURSE.

IF THEY HADN'T REVERSED COURSE WE WOULD HAVE BEEN HERE BEFORE THE CITY COUNCIL AND FEBRUARY OR SO OF 2022 RECOMMENDING THAT THE CITY COUNCIL, JUST AS WE ARE TONIGHT, BASICALLY SAYING THE BOARD IS RECOMMENDING THAT THE PATIO GO AND WHETHER OR NOT THE COUNCIL WANTED TO MOVE FORWARD AND BASICALLY SAY THAT YOU WERE NO LONGER GOING TO ALLOW FOR THE OUTDOOR EXPANDED PATIO AREAS IN THE DOWNTOWN, LIKE YOU AUTHORIZED IN THE SUMMER OF 2021.

COME AGAIN.

SO THAT JANUARY MEETING, THE BOARD AGREED FOR A TWO YEAR PERIOD AT A MINIMUM, THAT THE PATIO WOULD BE ALLOWED TO REMAIN SO THAT THE OWNERS COULD BASICALLY AMORTIZE THEIR COSTS THAT THEY HAD INVESTED IN BUILDING OUT THE PATIO THAT THEY HADN'T BEFORE.

SO COMING UP ON IN FEBRUARY, AT THE BOARD'S MEETING IN FEBRUARY OF THIS YEAR IT WAS ON THE AGENDA FOR FURTHER DISCUSSION ON WHETHER WHAT THE BOARD'S RECOMMENDATION WOULD BE REGARDING THE OUTCOME OF THAT PATIO SINCE THE TWO YEARS HAD EXPIRED.

THE BOARD VOTED AT THAT MEETING TO TEMPORARILY TO EXTEND OUT BASICALLY ON A MONTH TO MONTH, THE ABILITY TO USE THE PATIO UNTIL THE END OF MAY SO THAT BOARD MEMBERS COULD INFORMALLY PULL THE OTHER BUSINESSES ON D STREET ON WHAT THE BUSINESS OWNERS OPINIONS WERE ON THE KEEPING OF THE PATIO.

SO AT THE BOARD'S MAY 13TH MEETING IT WAS AGENDIZED AND THAT'S WHEN WE RECEIVED A RECOMMENDATION AFTER LENGTHY DISCUSSION BY BUSINESS OWNERS, THE BOARD, OTHER PEOPLE THAT WERE IN ATTENDANCE.

OH, SO AT THAT MEETING, THE OWNERS OF THE BUSINESS PRESENTED SOME STATISTICS WHICH ARE PART OF THE AGENDA PACKET TONIGHT ON THE USAGE OF THE PATIO AND APPROXIMATELY BY MONTH. HOW MANY PEOPLE USE THE PATIOS? OBVIOUSLY, YOU'LL SEE THAT IT HAD A HEAVIER USE DURING THE SUMMER MONTHS.

AND THEN THE BOARD MEMBER THAT TOOK THE INFORMAL POLL REPORTED THAT APPROXIMATELY 80% OF THE BUSINESSES THAT WERE INTERVIEWED SUPPORTED THE REMOVAL OF THE PATIO.

THEN AFTER A LENGTHY DISCUSSION AND ON A 3 TO 2 VOTE, THE BOARD VOTED TO ALLOW THE PATIO TO REMAIN THROUGH THE END OF THIS CALENDAR YEAR AND BE USED BY THEN.

SO STAFF TAKES THAT AS BASICALLY BEING UTILIZED THROUGH DECEMBER 31ST, AND THEN WE'D HAVE TO PROVIDE THEM SOME AMOUNT OF TIME TO PHYSICALLY REMOVE THE PATIO.

STAFF IS ESTIMATING A 30 DAY WINDOW SHOULD BE SUFFICIENT THAT THE TO TEAR DOWN AND RESTORE THE THREE PARKING SPACES THAT IT CURRENTLY OCCUPIES BACK TO THE WAY IT WAS BEFORE THE PATIO WAS BUILT.

AS I MENTIONED BEFORE, THE CITY COUNCIL DOES HAVE THE FINAL DETERMINATION ON THIS MATTER.

AS AN ALTERNATE TO THE BOARD'S RECOMMENDATION.

YOU CAN DECIDE TO HAVE THE PATIO REMOVED SOONER OR IN A SHORTER AMOUNT OF TIME OR YOU COULD ALSO MOVE FORWARD AND PRESENT A DIFFERENT LENGTH OF TIME LONGER.

I WOULD SUGGEST, IF ANYTHING BEYOND THE BOARD'S RECOMMENDATION OR IMMEDIATE, THAT IT WOULD BE BROUGHT BACK TO THE CITY COUNCIL FOR ANOTHER DISCUSSION BEFORE THE OWNERS ARE BASICALLY ORDERED TO REMOVE THE PATIO.

ATTACHED TO THE REPORT WERE THE MINUTES OF THAT MAY 13TH BOARD MEETING AND THEN THE OWNERS REQUEST IN AN EMAIL TO THE REASONS WHY THEY WISH TO KEEP THE PATIO ON AN INDEFINITE BASIS.

THEN ALL THE PUBLIC COMMENTS WE'VE RECEIVED VIA EMAIL OR LETTERS OF BOTH IN FAVOR OF REMOVAL OF THE PATIO AND IN OPPOSITION TO THE REMOVAL OF THE PATIO AGAIN, WERE PART OF THE PACKET.

AND ADDITIONAL COMMENTS ARE ON THE DAIS TONIGHT FOR YOU.

GENERALLY SPEAKING, THOSE THAT ARE OPPOSED TO IT CITE THE LOSS OF THE THREE PARKING SPACES THAT THE PATIO OCCUPIES AND THEN THOSE THAT ARE IN SUPPORT OF IT REMAINING, IDENTIFY THE LIVE ENTERTAINMENT AND THE AMBIANCE THAT ADDS TO OLD TOWN AT NIGHT.

SEPARATE FROM THIS ISSUE, BUT ALSO RELATED.

IN SEPTEMBER OF 2019, THE CITY ADOPTED A POLICY REGARDING INCIDENTAL OUTDOOR DINING AND FURNITURE DISPLAY.

THAT WAS IN HOPES TO TRY TO PUT A LIMIT ON THE KIND OF UNWIELDY GROWTH THAT WE HAD SEEN ON THE SIDEWALKS IN OLD TOWN.

IN TERMS OF A TABLE ADDED HERE, A DRESS MANNEQUIN ADDED THERE, A RACK OF CLOTHING, YOU KNOW, A COUPLE CHAIRS OR THINGS THAT WERE JUST KIND OF BEING ADDED TO THE PUBLIC SIDEWALK. NOT ONLY ARE THERE LIABILITY CONCERNS WITH THAT, SINCE IT IS CITY SIDEWALK, THERE'S ADA CONCERNS ABOUT HAVING ACCESS AND LIMITATIONS ON WHERE THEY COULD BE PLACED THE CONDITIONS, ETC.

SO WORKING WITH THE PUBLIC WORKS DEPARTMENT OVER A SERIES OF TIME, THIS POLICY WAS ADOPTED BY THE CITY MANAGER IN SEPTEMBER OF 19.

WE ARE ABOUT READY TO START ENFORCING THAT AND THEN WITH COVID, OBVIOUSLY ALL THOSE RESTRICTIONS WENT AWAY.

WE DO HAVE A DESIRE TO REINSTITUTE OR TO RE ADOPT, IF YOU WILL, THAT POLICY.

BUT OBVIOUSLY WE KNOW MORE NOW ABOUT OUTDOOR DINING AND WHAT THOSE PARAMETERS MIGHT BE AND AFTER COVID AND WE ARE WORKING INTERNALLY TO UPDATE THAT POLICY TO BRING BACK TO THE CITY COUNCIL.

BASICALLY, THAT POLICY, AS WRITTEN PREVIOUSLY ALLOWED FOR BUSINESSES TO HAVE EITHER TWO TABLES AND FOUR CHAIRS OR A SIX SQUARE FOOT AREA OF OUTDOOR DISPLAY IN THE PUBLIC SIDEWALK WITH A BUNCH OF DIFFERENT CONDITIONS, SUCH AS BY FEET CLEAR TO MAKE FOR PEDESTRIANS TO MANEUVER AROUND THE AREAS, NOT BLOCKING EMERGENCY EXITS, ETC.

ANYTHING MORE THAN THAT WOULD REQUIRE A SEPARATE LEASE AGREEMENT, SIMILAR TO WHAT WE HAVE WITH OTHER RESTAURANTS THAT LEASE PUBLIC SPACES IN OLD TOWN, NOT NECESSARILY IN SIDEWALK AREAS, BUT IN FORMER ALLEYWAYS OR IN TRANSPORTATION PLAZA.

SO WE'RE LOOKING AT ALL THOSE TO REVAMP THOSE AND MAKE SURE THAT WE'RE CONSISTENT IN ALL OF THEM.

SO IF A RESTAURANT THAT TODAY HAS MORE THAN TWO TABLES AND FOUR CHAIRS ON THE SIDEWALK WISH TO MAINTAIN MORE THAN THAT, THERE WOULD HAVE TO BE A LEASE NEGOTIATION WITH THE

IN ALL CASES, ANYBODY PLACING THINGS IN THE PUBLIC RIGHT OF WAY WOULD REQUIRE IT TO HAVE INSURANCE POLICY INDEMNIFYING THE CITY, WHICH IS SOMETHING THAT WE DON'T NECESSARILY HAVE TODAY AND SO THAT'S ANOTHER CONCERN.

SO WE ARE ANXIOUS TO HAVE THE SIDEWALK POLICY BACK IN BEING ENFORCED.

BUT WE FELT THAT THIS ISSUE WITH THE CAFE WONG'S PATIO KIND OF NEEDED TO BE BROUGHT UP AND ADDRESSED BEFORE TO AT LEAST GIVE STAFF DIRECTION ON HOW TO PROCEED WITH THAT POLICY UPDATE.

I KNOW THE OWNERS ARE HERE TONIGHT.

I KNOW THERE ARE OTHER PEOPLE THAT WISH TO SPEAK ON THIS ITEM, AND SO I'M HAPPY TO ANSWER ANY QUESTIONS THE COUNCIL MAY HAVE AT THIS TIME.

SO THERE'S OTHER PLACES THAT DO NOT HAVE CORRECT CURRENT LEASE AGREEMENTS AND WOULD NOT BE IN COMPLIANCE WITH THAT POLICY THAT WAS ADOPTED IN SEPTEMBER 19TH AND BUT CAFE WONG'S OUTDOOR SPACE HAS A CURRENT LEASE, HAS A CURRENT INSURANCE POLICY AS AN INSURANCE POLICY FOR THE AREA WITHIN THE PARKING SPACES.

YEAH, BUT NOT THE.

I DON'T RECALL IF THE INSURANCE COVERS THE AREA IN THE SIDEWALK.

I WOULD ASSUME THAT WE WOULD HAVE REQUIRED THAT TO AT THE TIME.

JUST BECAUSE WE HAD THE POLICY.

BUT I DON'T RECALL BECAUSE THEY ALSO DO HAVE TABLES AND CHAIRS IN THE SIDEWALK AREA, NOT IN THE PARKING SPACES AND JUST TO MAKE SURE.

BUT THAT ONE, WE'VE REALIZED DOES NOT PAY A FEE AND SO THAT'S SOMETHING ELSE THAT WE WILL BE ADDRESSING THROUGH THIS WHOLE PROCESS.

SO THEY HAVE ALLEGRO HAS A LEASE AGREEMENT.

SO THEY HAVE CITY APPROVAL.

OLD TOWN. LA VERNE WAS A GHOST TOWN IN THE 70S.

WHEN I MOVED HERE AND WHEN I WAS A STUDENT AT CAL POLY AND BUT IT'S ALSO ENJOYED A RESURGENCE OVER WITH FURTHER CHALLENGES. I HAVE LEARNED THAT WE MUST DO ALL WE CAN TO PROTECT QUALITY BUSINESSES IN OLD TOWN.

IT'S VERY HARD TO RECOVER FROM BUSINESS FAILURE AND VACANCY.

CERTAINLY LEARNED THAT OVER MY CAREER.

WHAT I FIND IS THAT THE AMBIANCE, THE ENERGY THAT'S CREATED BY LIVE MUSIC ON A PATIO FOR OUTDOOR DINING IS REALLY ATTRACTIVE TO A LOT OF DIFFERENT PEOPLE AND WHETHER YOU'RE A VISITOR, A PROSPECTIVE STUDENT AT THE UNIVERSITY PARENTS, YOU KNOW, BRING, YOU KNOW, FAMILIES THAT COME EVEN RETIREES WHO ARE JUST OUT FOR A STROLL, THEY GET ATTRACTED AND THEY COME AND SPEND TIME IN THE DOWNTOWN AREA WHEN OTHERWISE THEY WOULD NOT.

THERE ARE SEVERAL REASONS FOR THIS POSITION.

ONE, NONE OF THE OTHER RESTAURANT VENUES AS SUCH HAVE SUCH A LARGE AND IMPOSING OUTSIDE DINING AREA.

NOT ONLY DOES THIS LOOK OUT OF PLACE ON D STREET, IT ALTERS THE LOOK AND THE APPEARANCE OF THE OLD TOWN AREA.

IT STICKS OUT LIKE A SORE THUMB.

OTHER BUSINESSES IN THIS AREA HAVE MAINTAINED THEIR CUSTOMER BASE WITH MORE MODEST AND LESS INTRUSIVE EXTERIOR SEATING.

THEY SEEM TO BE THRIVING.

I'M NOT SURE THAT CAFE WANG WOULD NECESSARILY CLOSE IF IT MOVED ITS BUSINESS INSIDE 100%.

PARKING HAS BEEN REDUCED, BUT MORE IMPORTANTLY.

THE DINING AREA IMPEDES VISIBILITY FOR PEOPLE WHO ARE BACKING OUT OF SPACES ADJACENT TO THE OUTDOOR DINING AREA.

I COULD NEVER PARK THERE BECAUSE I COULD NEVER BACK OUT OF THERE FOR FEAR OF BEING REAR ENDED BY SOMEBODY COMING UP D STREET AND FOR PEOPLE WHO ARE TRAVELING NORTH ON D STREET, THERE IS ALSO DANGER FOR PEOPLE WHO ARE IN THOSE ADJACENT PARKING SPACES, BUT NOT VISIBLE IF THEY'RE IN SMALL CARS BACKING OUT RAPIDLY. SO I WORRY ABOUT THAT.

I FOURTH. FOURTHLY, I BELIEVE THAT CITIZENS CAN RELY ON MEMBERS OF THE OLD TOWN BUSINESS IMPROVEMENT DISTRICT ADVISORY BOARD AND THE PLANNING COMMISSION TO HAVE MADE THE RIGHT DECISION WHEN THEY VOTED TO HAVE THE STRUCTURE REMOVED.

THAT WAS ABOUT IT AND WITH THE RESURGENCE OF THE UNIVERSITY OF LA VERNE AND EFFORTS BY THE CITY THE LAST 40 YEARS HAS BEEN JUST AMAZING FOR OLD TOWN.

WHEN I TALK TO PEOPLE ABOUT WHY SOMEBODY SHOULD COME TO OLD TOWN, I AM REALLY PROUD NOW TO BE ABLE TO SAY IT'S A GREAT PLACE TO COME AND ENJOY AN EVENING, TO WALK AROUND.

FRANKLY, FIND IT QUITE ATTRACTIVE.

IT'S BEEN ENJOYED ON OUR EVENTS.

ONE MOST RECENTLY, THE WINE WALK.

AND IT'S NICE TO SEE THE STREETS PACKED WITH PEOPLE, CUSTOMERS WANTING TO COME.

I'D LIKE TO JUST SAY A COUPLE MORE THINGS.

CONCERNING KEN AND FONG.

I'VE GOTTEN TO KNOW THEM OVER THE LAST SEVERAL YEARS.

AS HAS BEEN MENTIONED, THEY HOST OUR OUR MONTHLY MEETINGS.

THEY'RE ALWAYS PUT OUT SOME REFRESHMENTS FOR US AND VERY WELCOMING.

THEY PARTICIPATED IN ALL OF THE ACTIVITIES OF OLD TOWN AND REALLY HAVE BEEN BECOME PART OF OUR OLD TOWN COMMUNITY.

I DON'T SEE IT AS TAKING AWAY.

I SEE IT AS AN ADDITION, AND I STRONGLY WOULD URGE THE COUNCIL TO CONSIDER THAT A TWO YEAR EXTENSION, MAYBE EVEN BEYOND THAT WOULD ONLY BE IN THE INTEREST OF OLD TOWN, WHICH, AS I LIKE TO THINK OF IT, AS THE HISTORIC CORE OF LA VERNE AND REALLY THE HEART AND SOUL OF OUR COMMUNITY.

I THINK IT'S ONLY POSSIBLE FOR IT TO CONTINUE TO BE OLD TOWN, TO CONTINUE TO BE A VIBRANT CENTER AND I WOULD LIKE TO SEE CAFE WANG BE A KEY PART OF THAT AND HOPE THAT WE CAN SUPPORT THEM IN THIS ENDEAVOR.

BEFORE YOU VOTE, I WOULD LIKE TO PROVIDE A RECAP OF THE MEETINGS WE HAVE HAD AS PART OF THE BUDGET PROCESS.

THE FIRST MEETING, HELD ON MAY 2ND, WAS WITH THE MEASURE ON OVERSIGHT COMMITTEE, WHERE WE DISCUSSED THE USE OF THE FUNDS AND IDENTIFIED THE RECOMMENDATION TO CITY COUNCIL.

THE NEXT MEETING WAS A STUDY SESSION ON MAY 6TH, WHERE FINANCE STAFF REVIEWED THE VARIOUS FUNDING SOURCES AS WELL AS THEIR SPECIFIC USES, AND PROVIDED A HIGH LEVEL OVERVIEW OF THE PROPOSED BUDGET.

THEN, ON JUNE 3RD, WE HAD THE BUDGET STUDY SESSION, WHICH PROVIDED AN IN-DEPTH LOOK WITH EACH DEPARTMENT PRESENTING THEIR BUDGET.

I PROVIDED AN OVERVIEW OF THE SPECIAL REVENUE FUNDS WITH CAPITAL OUTLAY, AND PUBLIC WORKS DIRECTOR MCQUADE PROVIDED THE CAPITAL IMPROVEMENT BUDGET DETAIL FOR THE 2425 PROPOSED BUDGET.

SINCE THEN, THERE HAVE BEEN A FEW CHANGES, ALTHOUGH NONE IMPACTING THE GENERAL FUND THAT I WOULD LIKE TO BRING TO YOUR ATTENTION.

THE FIRST AND LARGEST CHANGE IS WITHIN THE FIDUCIARY FUNDS.

THIS IS PART OF A GRANT THAT IS FULLY FUNDED WITH FEDERAL FUNDS.

THE INCREASE TO THAT SECTION OF 2.4 MILLION WAS DUE TO AN ERROR IN THE AMOUNT THAT WAS ENTERED DURING THE INITIAL BUDGET PROCESS.

THE NEXT CORRECTION IS WITHIN THE INTERDEPARTMENTAL FUND, WHICH IS A FIGURE THAT IS BACKED OUT OF THE NET APPROPRIATIONS AS IT IS FUNDED BY OTHER DEPARTMENTS.

THIS AMOUNT WAS INCORRECT DUE TO THE ADJUSTMENT OF SPECIAL PROGRAMS OF 1.3 MILLION INCREASE, WHICH WAS AN INCREASE IN THE RISK MANAGEMENT AND INSURANCE APPROPRIATION THAT WAS ALSO MISSED IN THE INITIAL FIGURES.

WE FOCUS A LOT ON THE GENERAL FUND AND SOMETIMES THOSE OTHER FUNDS.

ONCE WE ARE GOOD WITH THE GENERAL FUND, WE GO BACK AND GO, OH DARN, WE MISSED THAT AND THAT'S KIND OF WHAT HAPPENED.

THE FINAL CORRECTION IS WITH THE CAPITAL IMPROVEMENT PROGRAM AND WAS A CLEAN UP DUE TO SOME PROJECTS BEING AWARDED AT THE LAST COUNCIL MEETING THAT WERE PULLED INTO FISCAL YEAR 23-24.

IN ADDITION, I WOULD LIKE TO PROVIDE A BRIEF OVERVIEW OF THE 103 MILLION APPROPRIATION FIGURE AS IT IS A VERY LARGE FIGURE.

THIS AMOUNT INCLUDES ALL APPROPRIATIONS, WHICH INCLUDE TRANSFERS AND INTERNAL SERVICE FUNDS TRANSFERS AND INTERNAL SERVICE FUNDS ARE PART OF THE TOTAL APPROPRIATIONS.

HOWEVER, THEY ARE NOT CONSIDERED EXPENSES AS THEY ARE THE MOVEMENT OF FUNDS WITHIN THE ORGANIZATION.

IN THE CASE OF TRANSFERS, THEY DO NOT INVOLVE THE ACTUAL PURCHASE OF GOODS OR SERVICES, AND IN THE CASE OF INTERNAL SERVICE FUNDS, THE EXPENSE IS RECORDED WITHIN THE INTERNAL SERVICE FUND AND WITHIN THE DEPARTMENT OR FUND RECEIVING THE SERVICE, SO IT WOULD BE DOUBLE COUNTED AND IS THEREFORE BACKED OUT OF THE TOTALS.

I BRING THIS TO YOUR ATTENTION AS THERE ARE VARIOUS TOTALS IN THE SUMMARY REPORT, SO I WANTED TO PROVIDE SOME CONTEXT FOR ANYONE WHO REVIEWED THE PROPOSED BUDGET THAT WAS POSTED ONLINE.

ADDITIONALLY, I WOULD LIKE TO NOTE THAT THE GENERAL FUND BUDGET HAS NOT HAD ANY CHANGES AND IS, AS WAS LAST REPORTED, WITH THE 49 MILLION BUDGET BEING BALANCED WITH THE USE OF 1.2 MILLION OF ASSIGNED FUND BALANCE, WHILE MAINTAINING A 25% RESERVE, 5% ABOVE THE CITY COUNCIL'S 20%

ROBERT LIVED IN LA VERNE MOST OF HIS LIFE, ATTRACTED TO THE SMALL TOWN FEEL THAT GIVES LAVERNE'S CHARM, WHICH HE ADORED.

ROBERT GRADUATED FROM BONITA HIGH SCHOOL IN 1974.

HE SPENT HIS CAREER WORKING IN THE HOSPITALITY INDUSTRY, WHICH SPOKE VOLUMES ABOUT THE KIND OF PERSON ROBERT WAS KIND, CARING AND ALWAYS WILLING TO HELP OTHERS.

HE WAS A VERY PROUD OF BEING A PART OF CERT, WHICH ALLOWED HIM TO GIVE BACK TO HIS COMMUNITY, WHICH WAS VERY IMPORTANT TO HIM.

IN ADDITION TO CERT, HE VOLUNTEERED FOR THE AMERICAN RED CROSS AND DONATED HIS TIME AT THE ELECTION POLLS.

HE IS SURVIVED BY HIS WIFE, PATRICIA OF 39 YEARS AND HIS TWO DOGS.

WE LOVE WALKING AND TALKING, LOVED WALKING AND TAKING TO THE LOCAL PARK.

HE WILL BE GREATLY MISSED AND REMEMBERED FOR HIS FRIENDLY NATURE AND WILLINGNESS TO CONTRIBUTE.
